Formal consultations regarding the draft proposals for the contract of the balancing responsible party (the BRP contract) and the contracts of the balancing service providers (the BSP contracts)
Today, 15 March 2018, Elia launches the formal public consultations regarding the above-mentioned proposals, which provide the market parties affected by these proposals the opportunity to react and submit their comments on these proposals.
Commission Regulation (EU) 2017/2195 of 23 November 2017 establishing a guideline on electricity balancing (hereafter referred to as “EBGL”) requires the Transmission System Operator to submit the Terms and Conditions for the Balancing Responsible Parties and the Balancing Service Providers, 6 months after the entry into force of this Regulation, to the relevant regulatory authorities.
In accordance with Article 18 of the ‘EBGL’, Elia, as Belgian Transmission System Operator, has prepared the following draft proposals:
- The contract for the Balancing Responsible Party (hereafter “BRP contract”); and
- Different contracts for the Balancing Service Providers (hereafter “BSP contracts”)
Important to mention is that the structure for the BRP and BSP contracts, as proposed by Elia, are mainly a restructuring of the existing contracts, more specific of the current ARP-contract and the General Framework Agreements (GFAs), since the content of these existing contracts already meet the requirements of Article 18 of the “EBGL”. The proposed changes have a triple objective: to align terminology between the contracts and the “EBGL”, to ensure conformity with article 18 of the “EBGL” and to ensure alignment with the new proposal for a Federal Grid Code.
The consultation period for these proposals will run from 15 March up to and including 15 May 2018, this for a period of 8 weeks.
